Terms of Service

1. Service Description

HygieneLeads provides a lead generation service for pest control companies. Our service monitors publicly available Food Standards Agency (FSA) data for businesses with poor hygiene ratings, analyses online reviews for hygiene-related keywords, and generates pre-written outreach emails. The service is delivered via a web application and daily email digest.

2. Account Registration

To use our service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Payment Terms

• The subscription fee is £149 per month, billed in advance.
• A 7-day free trial is available for new customers. No payment is required during the trial period.
• Payment is processed securely via Stripe. We do not store your card details.
• All prices are inclusive of VAT where applicable.
• We reserve the right to change pricing with 30 days' written notice.

4. Cancellation

• You may cancel your subscription at any time by contacting us or through your dashboard.
• 30 days' notice is required for cancellation.
• Upon cancellation, you will retain access to the service until the end of your current billing period.
• No partial refunds are provided for unused portions of a billing period.

5. Use of Service

You agree to:

• Use the service only for lawful business purposes.
• Comply with all applicable laws and regulations, including UK GDPR and PECR, when using lead data for outreach.
• Not misrepresent your business or services in outreach communications.
• Not redistribute or resell lead data to third parties.
• Not attempt to reverse engineer, scrape, or otherwise access our systems in an unauthorized manner.

6. Data Accuracy Disclaimer

Lead data is sourced from publicly available FSA records and third-party review platforms. HygieneLeads does not guarantee the accuracy, completeness, or timeliness of this data. You are responsible for verifying all information before using it in outreach campaigns. HygieneLeads is not affiliated with or endorsed by the Food Standards Agency.

7. Intellectual Property

All content, software, and materials provided through the service are the property of HygieneLeads or its licensors. You may not copy, modify, distribute, or create derivative works without our express written consent.

8. Limitation of Liability

To the maximum extent permitted by law, HygieneLeads shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. The service is provided "as is" and "as available" without warranties of any kind.

9. Indemnification

You agree to indemnify and hold harmless HygieneLeads from any claims, damages, or expenses arising from your use of lead data in outreach communications, including but not limited to claims of unsolicited commercial email, harassment, or misrepresentation.

10. Modifications

We may modify these terms at any time. Material changes will be communicated via email with at least 30 days' notice. Continued use of the service after changes take effect constitutes acceptance of the revised terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
